Tadbeer 2-Year Warranty, 6-Month Probation & MOHRE Disputes
Full explanation of mandatory warranty rights: 6-month probation replacement guarantees, pro-rata refund calculations, and Twafouq complaint filing.
The Mandatory 2-Year Warranty for Package 1 Hiring
MOHRE regulations impose a statutory 2-year warranty on all domestic workers hired through Package 1. The warranty safeguards the employer's financial investment and is divided into two distinct legal stages: the initial 6-month probationary guarantee period and the subsequent 18-month extended warranty phase.
Probationary Phase (First 6 Months): 100% Replacement or Refund
During the first six months from arrival, the sponsor is entitled to a full refund of recruitment fees or a free candidate replacement if: (1) The domestic worker terminates the contract without a legitimate cause, (2) The worker absconds or refuses to perform assigned duties, or (3) The worker is found medically unfit due to a pre-existing medical condition that was undetected during overseas testing.
Post-Probation Phase (Months 7 to 24): Pro-Rata Refund Schedule
If a worker terminates the contract or refuses work during months 7 through 24 without fault on the employer's part, the center is required to issue a partial, pro-rata refund of recruitment fees calculated on the remaining months of the 2-year contract. Formula: (Total Recruitment Fee ÷ 24 Months) × Remaining Unserved Months.
Handling Worker Absconding (Escape / Runaway Protocol)
If a domestic worker leaves the residence without permission, the sponsor must file an official Absconding Report (Circular) within 5 working days via the MOHRE smart app or an approved typing/Tadbeer center. Filing this report relieves the sponsor of legal liability for any subsequent actions taken by the worker and activates the center's warranty claims procedure.
How to Resolve Disputes Through MOHRE and Twafouq
If a dispute arises between an employer, worker, or Tadbeer center that cannot be amicably resolved, either party may file a formal complaint via the MOHRE Toll-Free Helpline (600590000) or smart app. The matter is referred to a Twafouq Labor Dispute Center, where official mediators conduct free conciliation hearings. If unresolved within two weeks, the dispute is referred to the labor courts.
